Georgia DWI Lawyer

DWI and DUI are terms that are used interchangably Georgia law. That is operating a vehicle while intoxicated with alcohol or other substances, or being under the influence of alcohol or other substances.

Although it can differ from state to state, in Georgia, it is illegal to drink while under the influence of alcohol to blood level or (blood alcohol content BAC) is 0.08 or more.

If an officer sees you driving dangerously or strangely they are permitted to pull you over. If they suspect you’re DWI/DUI they are allowed to conduct more tests, such as a breathalyzer to test your BAC. Refusal of tests may result in a licence ban.

If an officer thinks you are physically or mentally impaired, it is possible to be convicted even if your blood alcohol level is below the limit. This can happen if you fail a field sobriety test, your motor movements were particularly bad or if you were clearly drunk in manner. This is more relevant if officers suspect that you were impaired by drugs or substances, which may result in a search of the vehicle for such items.

Typical penalties for DWI/DUI if it is your first offence may result in a temporary driving ban, points on your licence and a fine. If you are a multiple offender a jail sentence is common. You will also be required to complete some kind of rehabilitation program, teaching you of the dangers involved with driving innaporopritely.
